For Thais,

“May” is the month with many holidays.

Especially in the year 2554, there may be many special ones,

including an important holiday for Thais labour, the National Labour Day [1, May].

And this year the  Labour Day  falls on a Sunday again

(Which maybe on the same day of many people’s weekly holiday).

Therefore, this is the source of a lot of questions about the legal traditional holiday scheduling

Key issues to be discussed about the traditional holiday

according to the Labor protection laws includes: -.

– Scheduling the traditional holidays.

– If the holiday falls on a weekly stop.

– Moving the holiday.

Section 29 of the Labour Protection Act. assign the employers to notify the holiday

to the employees in advance, which in one year not less than 13 days, including the National Labour Day.

In addition to including the National Labour Day in one of the thirteen days,

the remain traditional holidays have to be set considering from other official holidays of the year.

(The same days government units stop every year), religious or local customs holidays.
If employers set other days, apart from the above, as the tradition holiday,

 it is considered to be fail from the labor protection laws.

If the traditional holiday falls on regular weekend holiday,

the employees are permitted to take the holiday only on the next workday instead.

For example, Labour Day falls on Sunday, a weekly holiday.

Employees can take a compensation holiday only on next Monday.

Requiring employees to stop the other day for compensation is unable.

Moving holiday, on accounted of the nature

 or conditions of work that can’t stop on traditional holiday,

according to the Ministerial Regulation No. 4 (2541), such as hotel work,
entertaining business, food stores, beverage outlets, clubs, associations, nursing unit, tourism
services units, jungle works, remote area works, transportation career, and the works that have
nature or conditions of continuity which will be damaged if stop.

In the case that employers are unable to allow their workers to stop on traditional holiday,

they and their employees have to make an agreement to stop working on the other day for compensation.

Or the employers can pay for work on the holiday time instead.
